Workers Compensation

Workers Compensation is a state statutory scheme to compensate you for the direct costs and effect of an injury incurred at your place of employment and within the scope of your duties there.

Your injury could occur off your employer's premises and still be covered if your duties are performed off premises. Your reinjury of an old covered injury can also be covered, even years later.

The primary steps of your case from your point of view are the following:

  1. Report the injury to your employer immediately.
  2. Write out a detailed statement of exactly how your injury occurred, especially any instances when you complained of the work condition which produced it.
  3. Meet early with an attorney to begin the process of obtaining compensation for medical expenses and the necessary medical opinion to support a later award of compensation.
  4. Keep track of all doctors or medical professionals you see and ask for copies of their evaluations or reports.
  5. Ask for and keep copies of all claim forms and notice forms you fill out or turn in to your employer.
  6. Keep a daily diary of your injury and the healing process and all actions taken and persons dealt with.
